Sony protects itself from class-action lawsuits with new PSN update agreement
Wow. You have disappointed me, Sony, you have really, really disappointed me. So much so I’m tempted to become a Microsoft fanboy. Yes, it’s that bad.
Sony has done a lot of things right with the PS3. But the Japanese technology giant has also done a hell of a lot wrong. Three things in particular have stuck in my craw this generation:
1. Removing backwards-compatibility from all but the 60Gb model of PS3.
2. Removing the ‘Other OS‘ option from the Playstation 3.
3. Allowing the system to be hacked so that personal details were compromised.
I know I’m not alone in being disappointed at these actions. Mainly because numbers 2 and 3 ended up with class-action lawsuits being brought against Sony. That means a lot of people felt passionate enough about the issues to join in with a legal fight against a company which can afford to keep the best lawyers on the payroll.
A class-action lawsuit is one which a large number of people collectively sue another party over one issue. They work because there is a certain strength in numbers. Which is unfortunate for Sony and other companies which have faced, and are still facing, class-action lawsuits in the face.
Sony’s solution is to remove the ability of users of its hardware to be involved in a class-action lawsuit. And they ensure this is the case by inserting the following clause into the new PSN update agreement:
ANY DISPUTE RESOLUTION PROCEEDINGS, WHETHER IN ARBITRATION OR COURT, WILL BE CONDUCTED ONLY ON AN INDIVIDUAL BASIS AND NOT IN A CLASS OR REPRESENTATIVE ACTION OR AS A NAMED OR UNNAMED MEMBER IN A CLASS, CONSOLIDATED, REPRESENTATIVE OR PRIVATE ATTORNEY GENERAL LEGALACTION, UNLESS BOTH YOU AND THE SONY ENTITY WITH WHICH YOU HAVE A DISPUTE SPECIFICALLY AGREE TO DO SO IN WRITING FOLLOWING INITIATION OF THE ARBITRATION. THIS PROVISION DOES NOT PRECLUDE YOUR PARTICIPATION AS A MEMBER IN A CLASS ACTION FILED ON OR BEFORE AUGUST 20, 2011.
This is sickening. Truly. It shows a company running scared from its own customers, and using an underhanded method to ensure they toe the line. Very few gamers even read the TOS when updating their console, and fewer still are going to bother writing to Sony within 30 days to register their desire not to agree with the clause, which is the only option Sony has given. Because providing a simple online form to do the same thing would clearly be too much trouble.
OK, so I’m not actually going to become a Microsoft fanboy because of this, as fanboys of all persuasion are inbred idiots. But my PS3 may get a little dusty sat in the corner unused for the next few months. It’ll make me feel better, even if it ultimately doesn’t make the slightest bit of difference.

1) Backwards compatibility- I still have my first PS2 and its in great condition. I have 3 slims also. And if you dont, you can buy a new one dirt cheap.
Because they took out this feature, i can buy a brand new PS3 starting at 250. Why the F^%@ are you even arguing?
2) Other OS- Never used it once and didnt plan to. They took it away, im still alive. I also heard it wasnt even that good. And if they DIDNT remove this feature….
3) Hackers- ….The PS3 would have been hacked to shit like 360. As if us gamers want that. You cant blame sony for being hacked by emo hackers.
Even if sony was hacked, im still alive and fine. My info wasnt taken or used. And sony is now the most secure game console network wise after the incident.
4) Lawsuits- Just because Sony doesnt want people making ridiculous lawsuits against them, doesnt mean sony is bad. They know how to run a company and they do these things for the best. For the good of the customers.
Youre point? You have none. I bet youll wake up tomorrow, walk to your entertainment hub half awake, turn on the 360, stare at the screen for 1 minute, say to yourself “What the fuck am I doing?!”, then tun off the 360 and the PS3 on.

I was and actually still am pissed about the removal of BC. Sure I could easily hook up my old PS2 again, but it’s the hassle of it. I mean I already have a Ps3, 360, Wii, TV and Sound System plugged in at the same time. To play a Ps2 game I have to uplug something and set it up again. Not hard I know but it’s still an inconvenience.

I got a bunch of PS2s plus 3 of my PS3 play PS2 games. I can careless about them removing it. But yeah for those unfortunate to own backwards compatible PS3 at least you get the collection. On my TV I got 4 HDMI and tv av inputs plus one dvi n another input weird.
If you not part of this PSN lawsuit you shouldn’t be hating Sony. I don’t see anything wrong with Sony protecting themselves from idiots suing for shit that will never happen to them.

once you agree to that statement, Sony can pretty much do what they want , they could, remove any features they liked, probably even its ability to play blu rays, and you wouldn’t have a leg to stand on because you just agreed not to sue them.
Now I accept that the odds are that they will not do anything so outrageous, but the fact remains that you’re giving them the permission to do so.
This is what happens when too many ass holes start suing corporations for stupid things.
The corporations react by getting you to sign up to what amounts to a draconian pre nuptial agreement that allows them to fuck you up the ass every night for the rest of your life.
In a way I don’t blame them, it had to happen sooner or later. I bet MS will follow suit soon enough.

Ok, so this has nothing to do with past issues otherwise the people that wanted to sue would have filed already. August 20th -2011 is the date.
This seems to strictly affect psn breech lawsuits.
To that I say, if have not already filed than too bad. It’s also just a tad hypocritical suing a company for their negligence with psn yet to continue to even want to use that service.
As for godless’s claim that this would affect future issues from being compensated on.
You can still take Sony to arbitration if you believe strongly enough in your convictions.
If you ask me, this really affects the slugs of society from jumping in on a class suite, which is for some of the laziest of plaintiffs.

I find nothing at all wrong with this. All it means is you can’t sue them in a class action suit. You can still individually sue them. This cuts out the people that just want to jump in on a class action suit without being affected.
The funny this is, Sony already gave more things away for free than any CAS has awarded to individual plaintiffs with his Welcome back program and two months of PSN Plus.

If they have a legitimate case a lawyer will take the case for free with him getting paid only if you win.
If not, one can always go through arbitration. It’s a lot quicker than court, but I don’t believe there’s punitive damage awarded which is fair anyway, as punitive damage is a crock of shit anyway.

I can freely admit when Sony does something that pisses me off. Removing other OS and this is not one of them. Taking out BC was a shit move, but seeing the polls on how many people even play older games on their new console it definitely looks like the correct decision to get the PS3 to competitive pricing.
I guess it could be worse. I hated seeing Happy defend everything MS. From defending that shit practice of theirs where they try and keep extra content off the PS3 if it’s not on the 360, to actually saying that people on live should just play with their friends as an answer to cheating rather that having it properly addressed.

My problem with these two Class Action Lawsuits is Sony and MS made good themselves. No one can ecpect to get anything more than what both MS and Sony did. With MS, extended the warranty and giving you a free month of god. With Sony, They got everyone identity theft protection, gave plus away for two months with three games.

Sony isn’t taking away anyone’s rights.
People have the right to read before they digitally sign an agreement, and they have the right to opt out 30 days after signing said agreement.
Any serious suit would involve personal injury, significant damage, or a major loss of funds due to negligence on Sony’s part, and any lawyer worth their salt would be able to successfully prosecute or settle out of court on an individual basis if such were the case.
I wouldn’t be surprised to see M$ and Ninty both follow Sony’s lead on this, and it is perfectly within their rights to have such a user agreement, especially when the user has the right to opt out of it.
